End User Licence Agreement
This End User Licence Agreement is between you and Sitation Ltd, trading as Sitation Apps. It covers the Sitation application and authorised customer-branded editions supplied by Sitation Ltd that link to it, including updates. The app's name, icon or customer branding does not change the licensor. Our Terms of Service govern the associated services.
1. Your licence
Subject to the applicable terms and entitlement, we grant you a non-exclusive, non-transferable licence to install and use the app on compatible devices that you own or control, or are authorised to use for your organisation, as permitted by the relevant distribution platform's usage rules. Organisational access and any volume-distribution rights are subject to the applicable agreement and platform rules.
You may make copies allowed by law and the platform rules. You may not sell, sublicense, redistribute or commercially exploit the software itself without permission. Restrictions on reverse engineering, decompilation and modification apply only to the extent permitted by law and do not prevent rights that cannot lawfully be restricted or uses expressly authorised by an applicable open-source licence.
2. Requirements and updates
The store listing and release information identify supported platforms and requirements. Internet access and an eligible verified account are required for supported cloud features; local features can have different requirements. Device permissions are requested for the relevant functions. An update may be needed for compatibility, security or continued access to a service.
3. Your records
You and the relevant rights holders retain rights in project records. The permissions needed to provide the service, and the position on shared project work, are set out in the Terms. This licence does not transfer employer-owned work to an individual user or grant unrestricted access to private content.
Use the app lawfully, with authority and appropriate privacy information for people whose data you record. Lawful recording of incidents, unsafe conditions, suspected wrongdoing and evidence for investigation is permitted. Using the app to facilitate unlawful conduct is prohibited. 4. Personal information and optional services
The Privacy Policy explains accounts, local and cloud records, device information, project sharing and service providers. Accepting this licence is not consent to unrelated optional processing. Advertising, where enabled, is covered by the separate Advertising Notice and applicable privacy choices. Organisation and feature notices explain differences in the app you use.
5. Data protection, availability and support
Protect your device and credentials, check sync status and export essential records. Uninstalling, clearing device data or losing a device can remove unsynced records. Synchronisation is not an assurance of complete backup or permanent preservation.
Sitation is responsible for its own support and any obligations under the applicable agreement and law. Contact support@sitation.app. We do not promise uninterrupted or error-free operation. Any stated service commitment and mandatory warranty or consumer right remains applicable; these terms do not replace them with a blanket disclaimer.
6. App stores
Your agreement is with Sitation Ltd, not the store operator. The relevant platform's terms also apply.
Apple distribution: for an Apple-distributed app, use is limited to Apple-branded products you own or control as permitted by Apple's usage rules, including applicable Family Sharing or volume-purchasing rules. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price as provided by its applicable terms; to the maximum extent permitted by law Apple has no other warranty obligation. Sitation is responsible for relevant product, legal-compliance, consumer and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
Google Play distribution: Google Play's terms govern store access, purchases and applicable store remedies. Sitation remains responsible for the app and its services. Apple-specific beneficiary wording does not create a corresponding Google obligation or right.
You must comply with applicable sanctions and export restrictions and with relevant third-party service agreements when using the app.
7. Suspension and termination
You may stop using the app at any time. We may suspend or terminate access for a material breach, security need or legal requirement, acting proportionately and providing notice or an opportunity to resolve matters where appropriate. Serious or urgent cases can require immediate action.
On termination, stop using the software except as permitted by law or an agreed export arrangement. Account closure, retained shared records, independent copies and subscription cancellation are explained in the Terms and Privacy Policy. Termination does not itself recall exported files or cancel store billing.
8. Liability and general provisions
The responsibility and liability provisions in the Terms and any applicable business agreement apply. Nothing in this EULA limits liability where unlawful or removes mandatory consumer rights. English and Welsh law applies, subject to mandatory local protections. If a provision is unenforceable, the remaining lawful provisions continue to apply.
